John Henderson of the Naples Daily News is reporting that a criminal case involving RUSH guitarist Alex Lifeson is expected to be resolved next month. It has been more than a year since Lifeson, whose real name is Alex Zivojinovich, was arrested for scuffling with Collier County sheriff's deputies at the Ritz-Carlton, Naples at a New Year's Eve bash ringing in 2004. He is facing two third-degree felony charges that could carry five-year prison sentences. Lawyers for both sides will update the judge on the status of the case at a hearing March 9. The hearing, called a sounding, was postponed from Wednesday after a judge granted a motion supported by the prosecution and Zivojinovich's defense attorney, Jerry Berry of Naples. The motion stated that the state plans to begin a first-degree murder trial on or about Jan. 17, and is anticipating that the trial will not be completed by Jan. 24, the date Zivojinovich's case was scheduled to go to trial. Also, Berry has to handle a DUI manslaughter case this month. Because both sides were so tied up with those cases, the judge decided to give them another month before resolving the case involving the internationally known rock star, who is a seasonal resident of Naples. A sounding hearing on March 9 also was granted for Justin Zivojinovich, Alex's son, who is facing a third-degree felony. At these sounding hearings, a judge can set a trial date, continue the case, or accept a plea bargain. Berry and prosecutor Rich Montecalvo had no comment when asked whether Alex Zivojinovich has been offered a plea bargain. Berry said most depositions are completed, with only a few loose ends to be tied up. "It's fair to say there is a good chance the case will be resolved in March," Berry said. March is just a sounding, which is a kind of pre-trial hearing. Is he expecting there to be a plea-bargain, then? I'm sure that the trial won't be in March, if there is one. I said yeah, I knew - they had front row seats and backstage passes to the Hartford show this summer, and didn't go. (They found out a few weeks later, while I was at the Toronto show, that I'm a huge fan!) She says "No, I mean about LAST New Year's Eve!" Turns out her family has a place in Naples, and she and her fiance were at the Ritz-Carlton and saw the start of the altercation. I should watch what I say - they might try to get her as a witness! (They saw Justin onstage, and the group being escorted out. They didn't see what happened with the cops, though). Now, why couldn't all this happen to a fan instead of them?!?!?! Im a U.S. citizen and i love my country. However, there are alot of Puds in our society that look for every oppurtunity to have a get rich quick scheme. Pathetic.......i bet you if a financial offer is made the whole thing might just go away.....example Kobe Bryant. I pray to God that Alex is exonerated from these charges. Not for anything ,but the report said Alex was highly intoxicated. So he might have reacted out of character when he saw his son getting pushed around. If he was your son or daughter how would you react..... protective i would think. Alex recieved a broken nose ,and was hit with a tazer gun repeatedly from what i have heard. I also heard that someone fell and they blamed it on Alex. Maybe getting physically assaulted caused the fall. Regardless ,no one died . They are making mountains out of moehills. I bet it largely stems from the fact that Alex is somebody of fame and wealth. If it was just some normal low income person they probably would have reduced or dropped the charges and let him go by now. I think Alex is being singled out and it infuriates me.
